Privacy Policy for Patients of Rückenwind plus

The following privacy policy applies to the use of our offered services and informs you as a patient or as a customer in another form, such as a relative using the services. 

Rückenwind plus AG undertakes to respect the customer’s privacy and to use customer data in accordance with business purposes. 

In principle, we offer our services in Switzerland and these are directed at persons residing in Switzerland.

Information on the Handling of Personal Data 

Below we inform you about the purpose for which Rückenwind plus collects, stores, or forwards your personal data. Additionally, we inform you about your rights, which you can exercise within the framework of data protection.  

Collection and Purpose of Data Processing  

The processing (collection, storage, use, and retention) of your data is carried out in accordance with the GTCs and legal requirements to fulfill the purpose of care and treatment as well as the associated obligations. Data is collected on the one hand by the treatment team of Rückenwind plus during your stay and the preparation for the stay. On the other hand, we also receive data from other doctors and healthcare professionals by whom you have been or are being treated, provided you have given your consent for this. In your care documentation, only data related to your medical treatment and care is processed. The care documentation includes the personal information provided during the admission process, such as personal details, contact data, and insurance information, as well as, among other things, the consultation sessions conducted during care and treatment, collected health data such as medical history, diagnoses, therapy proposals, and findings. 

Retention Period  

Your medical record will be kept for 20 years after your last treatment. After that, it will continue to be kept with your express consent or securely deleted or destroyed.  

Processing by Rückenwind plus 

With your signature on the document “Consent to GTC, Data Protection and General Consent”, you agree to the data processing for the purpose of your stay at Rückenwind plus.  

You also consent to your name being displayed on the room and at the table. This consent is given on a voluntary basis and can be withdrawn at any time.  

Disclosure of Data  

Employees respect your privacy and are committed to confidentiality. We only transfer your personal data, and in particular your medical data, to external third parties if this is legally permitted or required, or if you have consented to the disclosure of the data as part of your treatment. Data transfer is encrypted.  

With your signature on the document “Consent to GTC, Data Protection and General Consent”, you agree to the following disclosures: 

• Disclosure to pre-treating and referring physicians and facilities (e.g., ParaHelp AG, SPZ Nottwil) to ensure continued care 
• Transmission to other service providers, provided these professionals are involved in the care situation at home, in a clinic, or a nursing home, and provided it concerns information that is important for care or supply 
• Transmission to your health insurance or to the accident or disability insurance and, if applicable, the canton is for the purpose of billing the services provided to you. The type of data transmitted is based on legal requirements.  
• Disclosure to cantonal and national authorities (e.g., cantonal medical service, health departments, etc.) is based on legal reporting obligations. 
• Transmission of data and samples to external laboratories 
• If necessary, the transmission of a transfer report to ambulance companies and post-treatment facilities 
• Information about presence and room number to visitors and callers 
• Transmission to referrers and cost bearers 
• In individual cases, granting access to records at the request of an insurer to verify billing, controlling, and/or determining the benefit claim, whereby you have the right to limit this access to the insurer’s medical consultant 
• Processing by our subcontractors (see list with processing purpose below) 
• If you use an Amazon Alexa device on the ward, you accept the corresponding terms of use (Amazon Terms of Use, Alexa Terms of Use, and Privacy Policies) 

Data protection at the receiving facilities is ensured by corresponding laws or contracts. 

In individual cases, depending on your treatment and your corresponding consent, data is transmitted to other authorized recipients. 

Your relatives and other reference persons only receive information if you expressly agree to this. 

You authorize Rückenwind plus to inform your designated contacts and other service providers involved in your treatment in case of need during the ongoing treatment process, but for no longer than two years thereafter. 

Withdrawal of Your Consent 

If you have given your express consent for data processing, you can withdraw a previously granted consent at any time, in whole or in part. The withdrawal or the request for a change of consent must be made in writing. As soon as we have received your written withdrawal and the processing cannot be based on any other legal basis than consent, the processing will be discontinued. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.  

Information, Access, and Handover  

You have the right to receive information about your personal data at any time. You can view your medical history or request a copy. If the handover of the copy involves disproportionate effort, fees may apply, which we will inform you of in advance.  

Right to Data Portability  

You have the right to have data that we process automatically or digitally handed over to yourself or to a third party in a standard, machine-readable format. This applies in particular to the transfer of medical data to a healthcare professional of your choice. If you request the direct transfer of data to another responsible party, this will only be done insofar as it is technically feasible.  

Correction of Your Information  

If you find or believe that your data is incorrect or incomplete, you have the option to request a correction. If neither the correctness nor the incompleteness of your data can be determined, you have the option to have a notice of dispute added.

The following categories of subcontractors process personal data as part of their services for Rückenwind plus: 

An appropriate level of security is ensured for all subcontractors. 

Changes  

Rückenwind plus may adjust this privacy policy at any time without prior notice. The current version published on our website shall be authoritative.  

We will inform you of changes affecting the processing purposes by email or in another suitable manner. If there is no legal basis for new or changed processing purposes, we will obtain your consent before processing.
