  1. Contracting Parties and Legal Basis<\/span> <\/span><\/p><\/li><\/ol><\/div>

    The contractual relationship <\/span>between<\/span> R\u00fcckenwind<\/span> plus <\/span>AG and patients<\/span><\/span> is <\/span>determined<\/span> by <\/span><\/span> <\/span><\/span><\/span><\/span> <\/span><\/p><\/div>

    1. t<\/span>he<\/span> declaration of <\/span>consent <\/span> <\/span> <\/span><\/p><\/li><\/ol><\/div>

      1. t<\/span>he<\/span> G<\/span>eneral Terms and Conditions<\/span> (GTC)<\/span> <\/span><\/span> <\/span><\/p><\/li><\/ol><\/div>

        1. the <\/span>general consent<\/span><\/span> <\/span><\/p><\/li><\/ol><\/div>

          Unless <\/span>otherwise <\/span>stated <\/span>in the <\/span>GTC<\/span><\/span>, the provisions of the <\/span>Swiss<\/span> Code of Obligations (CO) apply, in particular the provisions regarding agency contracts (Art. 394 et seq. CO).<\/span><\/span> <\/span><\/p><\/div>

          <\/span><\/p><\/div>

          1. Framework Conditions <\/span>and Spitex <\/span>S<\/span>ervices<\/span><\/span> <\/span><\/p><\/li><\/ol><\/div>

            <\/span><\/span>R\u00fcckenwind<\/span> plus<\/span> unterst\u00fctzt die <\/span>patients <\/span>with <\/span>specialized <\/span>nursing, <\/span>care<\/span>, <\/span>consulting<\/span> and treatment services. <\/span>In doing so, <\/span> the resources of the<\/span> patients are <\/span>considered and <\/span>involved<\/span> whenever possible.<\/span> If necessary, services are adapted to changing circumstances by mutual agreement. <\/span>The indication for a stay at <\/span>R\u00fcckenwind plus <\/span>for<\/span> specialized<\/span> temporary care with <\/span>the necessary<\/span> medical<\/span> service<\/span>s<\/span> is for people<\/span><\/span> with paraplegia and <\/span>paraplegia-like<\/span><\/span> symptoms or neurological diseases such as Parkinson’s, Multiple Sclerosis (MS) and <\/span> Amyotrophic<\/span> Lateral Sclerosis (ALS). <\/span>Financing varies individually<\/span> and depends on whether it is an accident<\/span> or an illness<\/span><\/span>. <\/span>The costs that<\/span> <\/span>the <\/span>patients<\/span> will incur are clarified before admission and communicated in writing.<\/span> <\/span><\/span> <\/span><\/p><\/div>

            <\/span><\/p><\/div>

            1. Obligations of R\u00fcckenwind plus<\/span> <\/span><\/p><\/li><\/ol><\/div>

              1. Assessment of Needs<\/span> <\/span><\/p><\/li><\/ol><\/div>

                R\u00fcckenwind plus assesses the care needs of every <\/span>patient <\/span>after admission<\/span>. For the assessment of needs, <\/span> the<\/span> interRAI <\/span>-Home<\/span>Care <\/span>instrument is used.<\/span> All services provided are <\/span>recorded in writing and sent to a doctor for <\/span>information<\/span> or<\/span> prescription<\/span> purposes.<\/span> Please refer to<\/span> the reservation confirmation<\/span> for the amount <\/span>we <\/span>charge<\/span>you for <\/span>the care services of R\u00fcckenwind plus.<\/span> The assessment of needs is covered by health insurance and will also be invoiced.<\/span><\/span> <\/span><\/p><\/div>

                The <\/span>patient <\/span>acknowledges that the <\/span>financial <\/span>scope <\/span>of nursing services<\/span> is limited by health insurers and municipalities <\/span>and<\/span> that <\/span>donated funds<\/span> must be<\/span> independently<\/span> generated<\/span> and used <\/span> by R\u00fcckenwind <\/span> plus <\/span>subsidiarily <\/span> for further care and support needs<\/span>. <\/span><\/span> <\/span><\/p><\/div>

                <\/span><\/p><\/div>

                <\/span><\/p><\/div>

                1. Service Provision<\/span> <\/span><\/p><\/li><\/ol><\/div><\/div>

                  R\u00fcckenwind<\/span> plus <\/span>ensures precise care for its<\/span> patients<\/span> 24 hours a day, 7 days a week. It is entitled, in cases of unreasonableness, to seek discussion with the <\/span>patient<\/span> and, in the event of a lack of understanding, to terminate care. Professional or medical reasons, threats of violence, exercise of violence, gross insults, sexual harassment, lack of cooperation, and health risks to employees<\/span> or fellow patients<\/span> may be considered.<\/span><\/span> <\/span><\/p><\/div>

                  1. Nursing Materials and Aids<\/span> <\/span><\/p><\/li><\/ol><\/div>

                    For Patients Without a Daily Flat Rate<\/span><\/span> <\/span><\/p><\/div>

                    In order for <\/span> <\/span>R\u00fcckenwind<\/span> plus to provide <\/span> precise <\/span>care <\/span> from the first day, <\/span>it is <\/span>necessary<\/span>, <\/span>that <\/span>the <\/span>patient <\/span> brings <\/span> the <\/span>necessary nursing materials <\/span>as well as medications <\/span>for the first<\/span> four days <\/span>from home <\/span>or from the previous treating institution. <\/span> <\/span><\/span> <\/span><\/p><\/div>

                    During the <\/span>stay<\/span> at R\u00fcckenwind plus, the <\/span>necessary <\/span>nursing materials <\/span>can be ordered<\/span>; however, a doctor’s prescription and a subsequent ordering process are required first. <\/span>Any <\/span>incurred <\/span>costs <\/span>resulting from prescriptions ordered by the doctor<\/span><\/span> are <\/span>to be borne by the patient<\/span>.<\/span><\/span> <\/span><\/p><\/div>

                    For Patients With a Daily Flat Rate<\/span><\/span> <\/span><\/p><\/div>

                    For patients using a daily flat rate, it is necessary to submit prescriptions to R\u00fcckenwind <\/span>p<\/span>lus at least four days before their admission. This allows for the timely ordering of nursing materials and medications.<\/span><\/span> <\/span><\/p><\/div>

                    <\/span><\/p><\/div>

                    R\u00fcckenwind<\/span> plus has some aids on site (e.g., shower wheelchairs, anti-decubitus mattresses); however, needs are clarified by telephone before admission so that the patient can bring their own aids if necessary. In individual cases, it may be necessary to rent additional aids. Accordingly, the nursing staff will clarify the rental <\/span>c<\/span>osts<\/span>, which are at the expense of the patient<\/span>, in advance<\/span> with the patient.<\/span><\/span> <\/span><\/p><\/div>

                    <\/span><\/p><\/div>

                    1. Liability<\/span> for Damage and Theft<\/span><\/span> <\/span><\/p><\/li><\/ol><\/div>

                      R\u00fcckenwind<\/span> plus <\/span>is liable for damage caused by its employees<\/span><\/span>. For damage caused by <\/span>patients<\/span>, their own private liability insurance is responsible.<\/span><\/span> <\/span><\/p><\/div>

                      R\u00fcckenwind<\/span> plus offers the free use of safes for val<\/span>uables in the patient rooms. R\u00fcckenwind plus is not liab<\/span>le for damage caused by theft.<\/span><\/span> <\/span><\/p><\/div>

                      <\/span><\/p><\/div>

                      1. Acceptance of Gifts<\/span> <\/span><\/p><\/li><\/ol><\/div>

                        <\/span>R\u00fcckenwind plus<\/span> employees <\/span>are prohibited<\/span> from accepting gifts or claiming advantages for themselves or others offered to them in connection with their professional activities. Small <\/span>courtesy <\/span>gifts <\/span>are excluded. All monetary gifts<\/span> for nursing and hospitality <\/span>staff<\/span> <\/span> go into the staff fund<\/span>, the use of which is decided upon with consideration for the employees.<\/span><\/span> <\/span><\/p><\/div>

                        1. Cooperation of Clients<\/span> <\/span><\/p><\/li><\/ol><\/div><\/div>

                          In order for precise care to be successful, appropriate <\/span>instruction or <\/span>briefing <\/span>on daily<\/span> care provision by <\/span>the <\/span>patient <\/span> or <\/span>their <\/span> relatives <\/span>is <\/span> required. <\/span>The <\/span>patient <\/span> agrees <\/span>to the use <\/span> of standard nursing materials. R\u00fcckenwind plus attaches particular importance to the use of aids that are essential for the health protection of the patient and the employees (e.g., non-slip mats, patient lifts).                           <\/span><\/p><\/div>

                          1. Medical Care and Emergencies<\/span> <\/span><\/p><\/li><\/ol><\/div>

                            <\/span>R\u00fcckenwind<\/span> plus maintains a collaboration with <\/span><\/span> Asana<\/span> Hospital <\/span>Leuggern<\/span>, the Swiss <\/span>Paraplegic<\/span> Centre, and <\/span>ParaHelp<\/span>. A medical round <\/span> takes <\/span>place <\/span>routinely<\/span>, <\/span>during which<\/span> changes in the health status <\/span>of the <\/span>patient <\/span> are <\/span>discussed.<\/span> <\/span><\/span>. <\/span>In the event of acute occurrences, <\/span>doctors are available by telephone; in <\/span> life-threatening <\/span>emergencies<\/span> , the ambulance is called and the <\/span>patient <\/span> is transferred <\/span>to <\/span> a suitable specialized clinic. <\/span><\/span><\/span> <\/span><\/p><\/div>

                            Furthermore<\/span><\/span>, there is a <\/span>contractual <\/span>cooperation with physiotherapists and occupational therapists<\/span>, as well as a laboratory<\/span> and pharmacy.<\/span><\/span> <\/span><\/p><\/div>

                            <\/span><\/p><\/div>

                            1. Tariffs and Invoicing<\/span> <\/span><\/p><\/li><\/ol><\/div>

                              The prices<\/span> for the services of R\u00fcckenwind plus are based on the Spitex tariff list<\/span> of the Canton of Aargau<\/span>, except for patients with a daily flat rate.<\/span><\/span> <\/span><\/p><\/div>

                              As a basis for invoicing, employees record their work performance electronically<\/span> on handheld devices<\/span>. <\/span> <\/span> <\/span><\/p><\/div>

                              Nursing services under the Health Insurance Act (KVG) are <\/span>invoiced directly to the <\/span>health insurance company<\/span>. The <\/span>patient<\/span> receives a copy of the invoice. <\/span><\/span>Patient contributions are <\/span>invoiced directly to the patients<\/span>.<\/span><\/span><\/span><\/span> <\/span><\/p><\/div>

                              Additional nursing expenses not covered by <\/span>health insurance <\/span>are<\/span> covered by R\u00fcckenwind<\/span> plus <\/span>exclusively through<\/span> external <\/span>private <\/span>or institutional <\/span>donors<\/span><\/span>.<\/span><\/span> <\/span><\/p><\/div>

                              From the fourth month onwards, there is a possibility that an individual flat fee will be incurred and invoiced to the patient. You will receive a corresponding notification at least two weeks in advance. <\/span> <\/span><\/p><\/div>

                              Invoicing takes place monthly with a payment period of 30 days.<\/span> <\/span><\/p><\/div>

                              <\/span><\/p><\/div>

                              Services <\/span>under the Accident Insurance Act are invoiced to the insurance company <\/span><\/span> <\/span> <\/span>or the insured person <\/span>according to valid agreements.<\/span> Any <\/span>patient contribution may be<\/span> charged directly to the <\/span>patient <\/span><\/span><\/span> depending on the accident insurance.<\/span><\/span><\/span> <\/span><\/p><\/div>

                              Hospitality services<\/span> amount to a maximum of 1<\/span>6<\/span>5 CHF per day. For a surcharge, relatives can also eat and stay overnight here, subject to consultation and capacity. <\/span> <\/span> <\/span><\/p><\/div>

                              <\/span><\/p><\/div>

                              1. Dispute Resolution and Jurisdiction<\/span> <\/span><\/p><\/li><\/ol><\/div>

                                All <\/span><\/span><\/span>complaints <\/span>and grievances from patients <\/span>related to <\/span>their stay at R\u00fcckenwind plus <\/span>are accepted exclusively by the <\/span>management<\/span> <\/span>.<\/span> The management will endeavor to find an amicable solution, involving the Board of Directors if necessary.<\/span><\/span> <\/span><\/p><\/div><\/div>

                                The court in Aarau has jurisdiction over legal disputes in connection with the services of R\u00fcckenwind plus.<\/span> <\/span><\/p><\/div>

                                <\/span><\/p><\/div>

                                G<\/span>eneral Consent<\/span><\/span> <\/span><\/p><\/div>

                                Information on the further use of health-related data and samples for research purposes<\/span> <\/span><\/p><\/div>

                                The detection and treatment of diseases <\/span>have<\/span> made enormous progress in recent decades. This development is the result of many years of research in which <\/span>nursing staff, <\/span>doctors, scientists, and patients of different generations are actively involved.<\/span><\/span> <\/span><\/p><\/div>

                                Research is significantly dependent on data from the medical histories of patients. This may include, for ex<\/span>ample, results from laboratory analyses, information on a therapy, or on hereditary predispositions to certain diseases. Biological material taken as a sample during a hospital stay and no longer required for diagnostic purposes is also very valuable for research. These leftover samples can be, for example, blood, urine, or tissue samples.<\/span><\/span> <\/span><\/p><\/div>

                                This information explains how you as a patient can contribute to medical progress and shows how your patient data and rights are protected.<\/span> <\/span><\/p><\/div>

                                How can you contribute to research?<\/span> <\/span><\/p><\/div>

                                By signing the <\/span>declaration of <\/span>consent<\/span>, you make your health-related data and left<\/span>over samples available for research at <\/span>R\u00fcckenwind plus AG. The consent applies to all data that has already been collected at R\u00fcckenwind plus AG or will be collected in the future. This applies in the same sense to the samples.<\/span><\/span> <\/span><\/p><\/div>

                                Your consent is voluntary. It is valid for an unlimited period unless it is revoked (withdrawn). You can revoke your consent at any time via the contact address below without giving a reason. After revocation, your data and samples will no longer be made available for new research projects.                                 How are your health-related data and samples protected?<\/span> <\/span><\/p><\/div>

                                Your data is <\/span>processed and protected at R\u00fcckenwind<\/span> plus AG in accordance with legal regulations. Only authorized employees, such as <\/span>nursing staff or <\/span>doctors, have access to the unencrypted data from your medical history and access to your unencrypted samples. These persons are subject to confidentiality. Your samples are stored in biobanks. A <\/span>biobank<\/span> is a structured collection of various samples under certain security regulations (biobank regulations). As a participating person, you have the right to inspect your data.<\/span><\/span> <\/span><\/p><\/div>

                                If your data and samples are used for research projects, they will be encrypted or anonymized. Encrypted means that all personal data such as your name or date of birth are replaced by a code. The key that shows which code belongs to which person is kept securely by a person not involved in the research project. Persons who do not have access to the key cannot identify you. If data and samples are anonymized, there is no key that leads back to you. <\/span> <\/span><\/p><\/div>

                                Who may use your health-related data and samples?<\/span> <\/span><\/p><\/div>

                                Your data and samples will be made available to authorized researchers at R\u00fcckenwind plus AG for research projects or can be used in research projects in collaboration with other public or private institutions (other hospitals or universities). The projects can be carried out in Switzerland or abroad. For research projects abroad, at least the same data protection requirements apply as in Switzerland.
